HJR 166 proposes a constitutional amendment allowing judges to deny bail to individuals accused of certain violent offenses or continuous trafficking of persons. The amendment defines "violent offenses" to include murder, aggravated assault against a peace officer, aggravated robbery involving a firearm, and aggravated sexual assault involving serious bodily harm or a deadly weapon. A district judge must issue a denial of bail order within seven days of the accused's incarceration. If the trial does not begin within 60 days, the order must be set aside unless the delay was requested by the defense. The accused would have the right to appeal the bail denial to the Texas Court of Criminal Appeals​.
