HB 1765 restricts the issuance of arrest and search warrants authorizing no-knock entries by peace officers. It defines a no-knock entry as an entry made without prior notice of the officer's authority or purpose. A magistrate may issue such a warrant only if the application is accompanied by a written statement approving the use of a no-knock entry, signed by the chief administrator of the requesting law enforcement agency or their designee. The warrant must also require officers executing it to be in uniform or otherwise clearly identifiable as peace officers. Only certain magistrates, including district court judges, statutory county court judges, and municipal court judges who are licensed attorneys, may issue these warrants, with exceptions for counties lacking qualified magistrates. The act applies to warrants issued on or after its effective date of September 1, 2025​.
