HB 2722 requires the Texas Commission on Environmental Quality (TCEQ) to deny air permits for new industrial facilities if their emissions would have a disproportionately adverse impact on low-income populations in the surrounding area. The bill mandates that TCEQ consider both the individual impact of the facility and the cumulative effects of multiple facilities in the area before approving a permit under the Texas Clean Air Act. The new regulation applies only to permit applications filed on or after September 1, 2025.
