HB 3122 amends the Health and Safety Code to create a legal defense for individuals charged with possession of controlled substances or marijuana if the product they possessed was labeled as a legal consumable hemp product and was purchased from a retailer the person reasonably believed was authorized to sell such products. This measure provides a safeguard for consumers who inadvertently purchase mislabeled or misrepresented hemp products​.
