HB 3167 strengthens penalties for organized retail theft by modifying how stolen property values are aggregated and expanding evidentiary rules in retail theft prosecutions. It allows the aggregate value of stolen merchandise over multiple incidents within 180 days to be used in determining felony charges. It also permits prior theft offenses to be introduced as evidence to establish intent and criminal collaboration. Additionally, the bill raises penalties for organized retail theft, with offenses involving stolen goods valued at $300,000 or more punishable by up to 99 years in prison and fines of up to $250,000​.
