HB 3338 restricts the permitting of concrete batch plants located in areas of a municipality that do not have zoning regulations. The Texas Commission on Environmental Quality (TCEQ) is prohibited from issuing new permits for concrete plants within five miles of a school, licensed daycare center, or hospital. The bill applies only to permit applications filed on or after September 1, 2025.
