HB 389 prohibits the purchase or facilitation of Texas lottery tickets through telephone, internet, or mobile applications. It establishes two criminal offenses: purchasing or ordering tickets by these methods is a Class C misdemeanor, and facilitating the purchase, such as accepting orders or arranging transactions for compensation, is a Class A misdemeanor. The Texas Lottery Commission is tasked with enforcing these prohibitions, which are set to take effect on September 1, 2025.
