HB 3998 requires school districts to submit annual facility usage reports to the Texas Education Agency (TEA). These reports must include information on the square footage and land acreage of each facility, student capacity, enrollment numbers, facility usage designations, and whether properties are leased or owned. TEA will compile this data into a public report unless certain information is deemed a security risk. The bill also revises school district transfer policies, allowing students to transfer between districts without requiring the approval of the receiving district. Schools may deny transfers only if capacity limits are exceeded, if the student has a history of serious disciplinary issues, or if a desegregation order prevents approval. If there are more applicants than available positions, the district must allocate transfers through a lottery system with priority given to certain student categories, such as children of district employees, military dependents, and students with special education needs. The bill prohibits charging tuition for student transfers and limits the grounds on which a district can revoke a student’s transfer approval during the school year.
