HB 4328 prohibits the use of a victim's gender identity or sexual orientation as a defense in the trial of a criminal offense. The bill prevents defendants from justifying the use of force or claiming reduced culpability based on their discovery of a victim’s sexual orientation, gender identity, or a nonviolent romantic or sexual advance made by the victim​.
