HB 4940 provides a new legal defense in intoxication-related offenses such as DWI. Defendants may argue that they consumed alcohol after the alleged offense but before chemical testing, thereby causing their blood alcohol concentration to exceed legal limits. This applies only if the state’s evidence relies on a breath, blood, or urine test.
