HB 5240 establishes a pretrial intervention and diversion program for certain nonviolent offenses. It applies to defendants who have not previously been convicted of a crime and who are charged with a nonviolent offense. If both the defendant and the prosecuting attorney agree, the court may defer proceedings and allow the defendant to enter a pretrial diversion program. The program may include community service and restitution payments to victims. If successfully completed, charges against the defendant are dismissed. The bill also increases the maximum allowable reimbursement fee for such programs from $500 to $1,000. The funds collected are designated for use in administering the pretrial diversion program. The law applies only to offenses committed after its effective date.
