HB 5467 creates the criminal offense of continuous manufacture or delivery of a controlled substance. A person commits this offense if, within 12 months or less, they engage two or more times in the manufacture or delivery of a controlled substance under Sections 481.112, 481.1121, 481.113, or 481.114 of the Health and Safety Code. The bill does not require a jury to agree on the exact dates or locations of each offense but mandates unanimous agreement that the person engaged in multiple violations. The offense is classified as a third-degree felony.
