HJR 115 proposes a constitutional amendment to permit judges or magistrates to deny bail to individuals accused of violent or first-degree felony sexual offenses or continuous trafficking of persons. The denial of bail must be based on clear and convincing evidence that bail and release conditions are insufficient to ensure the accused's court appearance or the safety of the community, law enforcement, or victims. Additionally, it mandates that judges impose the least restrictive bail conditions necessary to achieve these goals. The resolution requires judges to document their findings and reasoning in a written order. The amendment will be placed before voters on November 4, 2025.
