HJR 162 proposes a constitutional amendment that would grant the Texas Attorney General (AG) the power to prosecute criminal offenses committed by peace officers while acting in their official duties. Currently, criminal prosecutions of law enforcement officers are handled by county and district attorneys, who may have conflicts of interest due to their working relationships with local law enforcement agencies. By granting the AG independent authority to prosecute these cases, the resolution seeks to ensure impartiality and uniformity in handling allegations of police misconduct. If approved by the Legislature, this amendment will be placed on the ballot for voter approval on November 4, 2025.
