SB 1258 establishes that pore space—the voids and cavities within geologic structures below the surface of the land—is legally owned by the surface estate owner, unless explicitly transferred, reserved, or modified in a deed, lease, or contract. This clarification does not change the common law relationship between mineral and surface estates.
