SB 1799 seeks to revise or eliminate the motor vehicle emissions inspection and maintenance program in Texas. The bill directs the Texas Commission on Environmental Quality (TCEQ) to identify the minimum emissions testing program required under the federal Clean Air Act and to submit a state implementation plan (SIP) revision to the U.S. Environmental Protection Agency (EPA). Under this plan, vehicle emissions inspections would only be required when a vehicle title is transferred, rather than during annual inspections. If the EPA approves the revised plan, the commission must implement the changes and recommend statutory modifications to the legislature to ensure compliance. Additionally, the bill includes a provision for full elimination of the emissions inspection program. If the U.S. Congress repeals or amends the Clean Air Act in a manner that eliminates the federal requirement for vehicle emissions testing, the Texas program would be automatically terminated 30 days later. However, if no federal change occurs, the elimination provision will have no effect. The bill takes effect September 1, 2025, except for the elimination provision, which is contingent on federal legislative action​.
