SB 1945 expands eligibility for Medicare supplement insurance plans to individuals under 65 years old who qualify for Medicare due to disability or end-stage renal disease (ESRD). The bill mandates that insurers offering Medicare supplement plans to those 65 and older must provide the same coverage at the same premium rate to younger individuals who qualify for Medicare. It also establishes open and special enrollment periods, including a six-month period upon first enrollment in Medicare Part B, a 60-day annual enrollment period beginning on the individual’s birth date, and special enrollment periods as determined by the Texas Insurance Commissioner. Insurers cannot deny coverage, impose exclusions for preexisting conditions, or engage in medical underwriting during these enrollment periods. The law takes effect September 1, 2025, and applies to policies issued or renewed on or after that date.
