SB 2574 , titled the Protection of Religious Liberty from Nativist Jurisprudence Act, restricts the enforcement of constitutional provisions commonly referred to as “Blaine Amendments,” which prohibit public funding of religious institutions. It prevents Texas government officials from enforcing these provisions unless the U.S. Supreme Court overturns previous rulings. Additionally, it limits enforcement of the Establishment Clause of the First Amendment against individuals or entities other than the federal government. The bill also establishes legal remedies for those who believe their religious liberty has been infringed upon and eliminates sovereign, governmental, and official immunity as defenses against such claims.
