SB 2902 provides protections for consumers who have incurred debt due to identity theft. It amends the Finance Code to prohibit creditors, debt collectors, and third-party debt collectors from attempting to collect a debt if the consumer provides proof that the debt resulted from identity theft. Proof can be in the form of a court order or a Federal Trade Commission identity theft victim report. The bill also requires debt collectors to cease collection efforts upon receiving such documentation, notify other entities that the debt is disputed, and prohibits the sale or transfer of the debt except to pursue collection from the actual perpetrator of the identity theft. If a debt collector suspects a fraudulent claim of identity theft, they may file a lawsuit to recover the debt from the consumer.
