SB 3001 requires Medicaid managed care contracts to allow nutrition counseling and instruction services as an alternative to other state Medicaid plan services. The bill amends Section 540.0272, Government Code, to authorize Medicaid managed care organizations to offer medically appropriate, cost-effective, evidence-based nutrition counseling in place of certain Medicaid-covered services. However, recipients are not required to use these alternative services. The bill directs the state Medicaid managed care advisory committee to approve a list of eligible nutrition counseling services but prohibits the inclusion of home-delivered meals, food prescriptions, or grocery support. Additionally, the Texas Health and Human Services Commission (HHSC) must submit an annual report to the legislature detailing the usage of these alternative services and consider their actual cost when setting capitation rates for managed care organizations. The bill applies to Medicaid contracts entered into or renewed on or after September 1, 2025, and allows state agencies to request federal waivers if needed for implementation​.
