HB 40 authorizes sheriffs and constables in counties with populations over 3.3 million to contract directly with residents, local governments, property owners’ associations, and certain businesses to provide law enforcement services, without requiring commissioners court approval. It also prohibits counties from transferring or restricting funds appropriated to sheriff or constable offices and ensures contract revenue remains with those offices.
