HB 78 establishes a legislative committee to review federal actions and allows the Texas Legislature, with approval from the Governor, to declare such actions unconstitutional. If declared, Texas and its subdivisions would be prohibited from recognizing or enforcing them. It also allows Texas courts to independently declare federal actions unconstitutional and bars enforcement of such actions within the state.
