HB 4939 changes the legal status of deer in Texas by allowing landowners to claim ownership of deer located on their property if the land is enclosed by a fence at least seven feet high that is capable of retaining the deer. This departs from current law, which considers all wild deer to be the property of the state. The bill also clarifies that constructing a fence does not restrict landowners from controlling wildlife movement on their property.
