HJR 16 proposes a constitutional amendment requiring the denial of bail for illegal aliens charged with felony offenses. It defines an "illegal alien" as someone who either entered the U.S. unlawfully or failed to maintain their nonimmigrant status. Under this amendment, if a judge or magistrate determines that probable cause exists to believe the individual committed a felony, bail must be denied. If approved by the legislature, this amendment will be submitted to Texas voters for approval in the general election on November 4, 2025​.
