Digest
HB 98 allows a judge to disqualify a district or county attorney from prosecuting election law violations if the attorney has adopted a policy of not prosecuting such offenses. Upon disqualification, the Texas Attorney General may be appointed to prosecute the case. The law is intended to increase state enforcement of election laws in jurisdictions where local prosecutors decline to act.
