Digest
HB 155 amends Section 11, Article 49.25, of the Texas Code of Criminal Procedure to modify the confidentiality of certain autopsy records. Specifically, the bill clarifies that autopsy photographs and x-rays are exempt from required public disclosure under Chapter 552 of the Government Code (the Public Information Act), except under specific circumstances. These circumstances include disclosure through a legal subpoena, for cases involving deaths in law enforcement custody, or to the deceased person’s next of kin or legal representative. The bill also specifies that releasing such images to a next of kin or legal representative does not waive future confidentiality claims.
