HB 167, titled the "Ending Institutional Racism Act," aims to eliminate diversity, equity, and inclusion (DEI) initiatives within Texas governmental entities. The bill prohibits governmental entities from establishing DEI offices, requiring DEI statements, or giving preferential treatment based on race, sex, color, ethnicity, gender identity, or sexual orientation in hiring, contracting, and other governmental functions. HB 167 also includes provisions for waiving sovereign immunity, allowing individuals affected by non-compliance to file lawsuits against governmental entities. It also amends existing procurement statutes to remove DEI-based preferences in public contracts.
