Digest
HB 1753 amends the Family Code to allow courts to order exclusive occupancy of the primary residence or other residential property by one spouse during the pendency of a divorce case. If the opposing party has been convicted or placed on deferred adjudication for specific family violence-related offenses within the last three years, the court must grant the requesting party exclusive occupancy. A party granted exclusive occupancy may move to vacate the order during the case. The act applies to divorce cases filed or pending on or after September 1, 2025.
