HB 1774 repeals Section 43.24(c) of the Texas Penal Code, which provides an affirmative defense to prosecution for the offense of sale, distribution, or display of harmful material to a minor. The repeal eliminates this defense, meaning individuals charged with such offenses will no longer have the option to use this legal defense. The changes apply to offenses committed on or after the effective date of the act, September 1, 2025.
