HB 1915 modifies Texas Family Code provisions related to possession orders for children under three years old in cases affecting the parent-child relationship. The bill requires courts to consider expanded factors when determining possession orders for young children, such as the child’s need for continuity, attachments, and routines, as well as the child’s environments and the impact of other individuals involved in their care. It emphasizes the importance of fostering healthy attachments with both parents, where possible, and introduces a preference for graduated possession schedules in cases of minimal or inconsistent parental contact. Courts must base possession orders on mutual agreements between parties unless such agreements are deemed not in the child’s best interest. The changes apply only to suits filed on or after September 1, 2025.
