HB 1919 creates a cause of action allowing individuals to sue the State of Texas for damages caused by the denial of health care services resulting from laws limiting or prohibiting access to reproductive health care, including abortion. Prevailing claimants may recover damages for bodily injury or psychological harm caused by such denials. The bill waives the state's sovereign immunity to the extent of this liability and applies to causes of action accruing on or after its effective date of September 1, 2025.
