HB 2023 proposes to amend the Texas Insurance Code to require health benefit plans that provide coverage for prescription contraceptive drugs to also cover emergency contraceptive drugs. The bill defines "emergency contraceptive" as a drug containing an elevated dose of hormones that is used postcoitally to prevent pregnancy by either preventing fertilization or implantation of a fertilized egg, and that is approved by the U.S. Food and Drug Administration. Under the proposed legislation, health benefit plans must cover emergency contraceptive drugs at least once per year without requiring a prescription for each enrollee. The bill applies to health benefit plans delivered, issued for delivery, or renewed on or after January 1, 2026.
