HB 2146 creates a civil cause of action for individuals harmed by the nonconsensual removal, alteration, or rendering ineffective of a condom during sexual contact. Under this legislation, a defendant is liable if they engage in sexual contact without a condom after such an action or while using an altered or less effective condom without the other party's consent. Claimants who prevail in a lawsuit under this chapter may be awarded actual damages, including mental anguish, court costs, reasonable attorney’s fees, and, potentially, exemplary damages. The bill applies to causes of action accruing on or after its effective date of September 1, 2025.
