HB 2172 amends the Code of Criminal Procedure to limit the use of unsubstantiated allegations of misconduct against peace officers. It prohibits law enforcement agencies from disclosing allegations of misconduct to prosecutors unless the allegations have been finally adjudicated as sustained. It also restricts prosecutors from considering unsubstantiated allegations when assessing an officer’s credibility. Peace officers may contest reports or determinations affecting their credibility through the State Office of Administrative Hearings.
