HB 2223 establishes protections for eviction case information by mandating that courts seal records in certain cases. If a tenant wins an eviction case, the case is dismissed without relief to the landlord, or the eviction is filed by a successor in interest after a foreclosure, the court must issue a confidentiality order. The bill also prevents consumer reporting agencies from using sealed eviction records in tenant screening reports and allows tenants to petition for record sealing post-judgment. Violations of these provisions can result in actual damages and attorney’s fees.
