HB 2422 requires sellers of residential real property to provide additional disclosures regarding water services and water rights. The bill amends the Property Code to mandate that sellers disclose the name of the entity regulating the water supply, the name of the entity responsible for billing, any excessive water use fees or pricing tiers, and the entity responsible for maintaining the water service line to the property. Additionally, the bill requires sellers to provide a separate written notice describing whether groundwater or surface water rights are included in the property sale. The Texas Real Estate Commission is tasked with developing the disclosure form. Buyers who do not receive the required disclosure may terminate the contract within seven days of receiving the notice.
