HB 243 grants the Texas Attorney General the authority to acquire real property through eminent domain if it is owned by foreign entities or individuals (classified as “aliens”) and poses a risk to critical infrastructure or violates state or federal law. “Critical infrastructure” is broadly defined to include sectors such as energy, communications, healthcare, and transportation. Under this bill, if the Attorney General demonstrates a risk to infrastructure or a legal violation, a district court may authorize eminent domain proceedings to acquire the property. Acquired properties would be managed by the Texas General Land Office. The bill mandates the Attorney General to establish rules for its implementation, effective September 1, 2025.
