Digest
HB 2449 modifies discovery requirements for pro se defendants (defendants representing themselves) in criminal cases. The bill amends the Code of Criminal Procedure to allow electronic duplication of evidence in certain circumstances. Previously, pro se defendants could inspect and review state evidence but were not automatically entitled to digital copies. Under this bill, courts may authorize electronic duplication, but sensitive information must be redacted before release. Before receiving digital evidence, pro se defendants must sign an affidavit acknowledging legal restrictions on disclosing or sharing the evidence. The law applies to criminal cases beginning on or after September 1, 2025.
