HB 2539 establishes a new criminal offense for prosecutorial misconduct. The bill makes it a second-degree felony for a prosecuting attorney to intentionally destroy, withhold, or fail to disclose evidence required under the Texas Code of Criminal Procedure if such actions substantially contribute to the wrongful conviction of an innocent defendant. Additionally, it criminalizes any intentional obstruction of an exoneration process by a prosecutor who knows the defendant is actually innocent.
