HB 2645 expands grandparents' legal rights to seek court-ordered possession or access to a grandchild. The bill removes the requirement that a grandparent must demonstrate that the child’s parent is incarcerated, deceased, found incompetent, or lacks custody before seeking visitation rights. Additionally, courts are required to appoint a guardian ad litem upon request to evaluate the child’s best interests, and expert testimony is no longer required for a grandparent to prove that denial of access would significantly harm the child’s well-being.
