Digest
HB 2772 creates an affirmative defense for individuals charged with certain crimes if they were coerced, acting under duress, or feared harm due to being victims of human trafficking, compelling prostitution, or family violence. It applies to individuals accused of offenses under Sections 20A.02 (trafficking of persons), 43.05 (compelling prostitution), or 22.01(b)(2) (assault involving family violence) of the Penal Code. This defense allows courts to consider evidence of victimization when determining criminal liability. The law applies to offenses committed on or after September 1, 2025.
