HB 2843 creates a civil cause of action for victims of sexual assault resulting in pregnancy. It establishes that a defendant who commits sexual assault can be held financially liable for damages arising from a pregnancy carried to term. Victims who prevail in a lawsuit may recover medical expenses, lost wages, child care costs, and other economic damages, as well as non-economic damages such as emotional distress. A criminal conviction is not required for liability to be established, and this cause of action is cumulative of other legal remedies, including child support claims.
