HB 288 introduces Section 481.142 to the Texas Health and Safety Code, establishing a second-degree felony offense for operating premises with the intent to allow or enable unlawful controlled substance use. The bill defines “premises” as per Section 46.03 of the Penal Code and specifies that the offense applies to anyone who knowingly owns, rents, leases, or manages a property to facilitate illegal controlled substance consumption. It also criminalizes the act of making premises available for this purpose, regardless of whether financial compensation is involved. If conduct under this offense overlaps with another offense, prosecution can proceed under multiple laws. The Act takes effect on September 1, 2025.
