HB 317 establishes a new chapter in the Texas Labor Code, giving employees the right to up to five days of unpaid leave following a reproductive loss, such as a miscarriage, stillbirth, or failed adoption. This time may be taken consecutively or intermittently, with a cap of 20 days for multiple reproductive losses within a 12-month period. Employers may request general certification of the reproductive loss but cannot require detailed information or documentation. Additionally, HB 317 prohibits retaliation against employees who take this leave.
