HB 3188 prohibits Supplemental Nutrition Assistance Program (SNAP) recipients from using benefits to purchase sweetened beverages, candy, chips, or cookies. However, the bill allows exceptions for milk products, milk substitutes (such as soy or almond milk), beverages with non-caloric sweeteners, infant formula, weight-reduction beverages, unsweetened fruit and vegetable juices, medically recommended drinks, plant-protein beverages, and fortified products containing a source of protein. If federal authorization is required to implement the prohibition, the responsible state agency must seek approval before enforcing the restrictions.
