Digest
HB 3285 establishes requirements for operators of smart devices to provide users with detailed information about the collection and use of personal data. Smart device operators, including manufacturers and entities that monitor or update devices, must create and maintain a mobile application that informs users about the types of personal data collected, the purposes of data collection, storage methods, and the identities of third parties accessing the data. Users must also be able to stop the acquisition of personal data and disable audio, biometric, or video recording features through the application. Notifications about the mobile application's availability and customization options must be sent to users quarterly. The act applies to businesses involved in smart device operations within Texas but excludes state agencies, political subdivisions, and utility providers.
