HB 3287 amends the Property Code to clarify that funds reserved under Section 53.101 for construction or repair projects are considered trust funds, except when used for single-family, duplex, triplex, or quadruplex residences. The bill expands the definition of beneficiaries to include laborers, contractors, and material suppliers and establishes that courts must award attorney’s fees and costs to beneficiaries who prevail in lawsuits against trustees for mismanagement of these trust funds. These provisions apply only to contracts entered into on or after September 1, 2025​.
