HB 3327 repeals the affirmative defense to prosecution for individuals accused of selling, distributing, or displaying harmful material to a minor under Section 43.24(c) of the Penal Code. Under current law, defendants may claim an affirmative defense if the material in question has educational, governmental, or scientific value for minors. By repealing this provision, the bill eliminates this defense, making it easier to prosecute offenses related to the sale or distribution of harmful materials to minors. The bill applies only to offenses committed on or after September 1, 2025.
