HB 3654 establishes an automatic process for nondisclosure of certain nonviolent criminal offenses from a person’s record after completing a sentence or deferred adjudication. Eligible individuals include those convicted of misdemeanors or certain lower-degree felonies, excluding first-degree felonies, violent crimes, sex offenses, intoxication-related offenses (except public intoxication), and traffic offenses punishable only by fine. To qualify, a person must not have any prior criminal convictions beyond traffic infractions, must have completed all sentencing requirements, and must not have previously received an order of nondisclosure for another offense. The Texas Department of Public Safety will review records monthly, notify courts of eligible individuals, and courts will automatically issue an order for nondisclosure unless the offense was violent or sexual in nature. The bill waives filing fees for eligible individuals and takes effect on January 1, 2026.
