HB 387 amends Section 21.165 of the Texas Penal Code to address the production and distribution of sexually explicit deep fake images or videos. The bill expands the definition of deep fake content to include images or videos created with the intent to deceive and that falsely depict real individuals engaging in actions that did not occur. It makes the production or distribution of such content without the depicted person's consent a state jail felony, increasing the penalty from a Class A misdemeanor. These changes apply to offenses committed on or after September 1, 2025.
